Authorizations & consent
Acceptance: I understand accepted athletes are contacted by email within 7 days of applying, at the email address provided above.
Contact-sharing: I authorize the Canadian Elite Softball Camp to share the athlete and family contact details (phone and email) with the camp's instructors, coaches, vendors, and operational staff as needed to organize and run the event.
Media: I consent to Line Drive Media photographing and filming the athlete at the camp, and to the athlete appearing in event coverage, promotion, and marketing on websites, social media, broadcast, and print, without compensation.
Waiver & release of liability
Parties: I am the parent or legal guardian of the minor athlete named in this application (the "Athlete"), I am at least 18 years of age, and I have full legal authority to enter into this agreement on behalf of myself and the Athlete. This Waiver, Release of Liability, Assumption of Risk and Indemnity Agreement (the "Agreement") applies to the Canadian Elite Softball Camp (the "Camp").
Assumption of risk: I understand that softball and participation in the Camp involve inherent and other risks, including but not limited to physical injury (up to and including serious or catastrophic injury) from thrown or batted balls, bats and equipment, collisions, running, sliding, throwing, overuse and fatigue, heat, sun and weather, playing-surface and facility conditions, the conduct of other participants, and travel to and from the Camp. I knowingly and voluntarily accept and assume all such risks, both known and unknown, on behalf of myself and the Athlete.
Release and waiver of liability: To the fullest extent permitted by law, I, on behalf of myself, the Athlete, and our respective heirs, executors, administrators, successors and assigns, hereby release, waive, discharge and covenant not to sue the Canadian Elite Softball Camp and its organizers, owners, operators, directors, officers, employees, instructors, coaches, staff, volunteers, vendors, contractors, sponsors and media partners, and the host facility and its owners and operators (collectively, the "Released Parties"), from any and all claims, demands, actions, causes of action, costs, damages and liability of any kind arising out of or in any way connected with participation in the Camp, INCLUDING ANY CLAIM CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASED PARTIES, to the fullest extent permitted by applicable law.
Indemnification: I agree to indemnify, defend and hold harmless the Released Parties from and against any claim, loss, liability, damage or cost (including reasonable legal fees) brought by or on behalf of the Athlete or any third party arising out of or related to the Athlete's participation in the Camp or my breach of this Agreement.
Health, fitness & medical authorization: I represent that the Athlete is physically fit to participate and has no medical condition that would make participation unsafe, and I have disclosed any relevant medical conditions, allergies or limitations to the Camp. In the event of injury or illness, I authorize the Camp and its staff to seek, arrange or administer first aid and emergency medical treatment, and I accept responsibility for all related costs. I am solely responsible for maintaining medical and accident insurance for the Athlete.
Communicable illness: I understand that any group activity carries a risk of exposure to communicable illnesses, and I voluntarily assume that risk on behalf of myself and the Athlete.
Personal property: The Released Parties are not responsible for any lost, stolen or damaged personal property.
No guarantee: I understand that participation does not guarantee any roster spot, playing time, recruitment, scholarship, media exposure or other outcome, and that any evaluations, coverage or feedback are provided without warranty.
Conduct & removal: I understand the Athlete is expected to follow all Camp rules and the reasonable directions of staff, and may be removed from the Camp without refund for unsafe, dangerous or disruptive conduct.
Changes, weather & cancellation: The Camp may modify the schedule, instructors, format or venue, and may suspend or cancel sessions for weather, safety or other circumstances beyond its reasonable control. Camp fees are non-refundable except as expressly stated by the organizers in writing.
Privacy: I consent to the collection, use and disclosure of the personal information provided in this application for the purpose of operating, organizing and promoting the Camp, including sharing it with the Camp's instructors, coaches, vendors, operational staff and media partner as reasonably necessary.
Governing law: This Agreement is governed by and construed under the laws of the Province of Ontario and the federal laws of Canada applicable therein, and I attorn to the exclusive jurisdiction of the courts of Ontario. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
Acknowledgment: I have read this entire Agreement, fully understand its terms, understand that I am giving up substantial legal rights (including the right to sue) on behalf of myself and the Athlete, and sign it freely and voluntarily. I agree that my electronic signature and submission of this form have the same legal effect as a handwritten signature.
